Terms and Conditions
Copyright Notice: Ahead Aerial Services, LLC (hereinafter referred to as “AAS”) is the exclusive copyright holder of all images and video produced by Ahead Photography. Licensing is offered for various image and video uses and applications.
Photo Rights and Usage for Property Photography: The original client is granted a limited license to use the images and video in any electronic or print media for advertisement and promotion of the property. The licensing agreement is valid only for the duration the property offering and cannot be reused without specific written permission from AAS. If the client is an MLS participant, licensing is hereby granted to the MLS specifically as described in Policy Statement 7.85 of the Handbook on Multiple Listing Policy as published by the National Association of Realtors®, to wit, a license is granted as necessary “for storage, reproduction, compiling, and distribution of listings and listing information to the extent necessary to fulfill the defined purposes of MLS”. Limited licensing is available for other uses with specific written permission from AAS.
Licensee may not sell or otherwise transfer licensed images or video to any third party, including another broker or agent who takes over an expired, withdrawn, or cancelled listing, sellers, buyers, builders, stagers, or any other contractor associated with the property or agent. Image and video licenses are non-transferable.
AAS holds licenses to use stock images, video footage, and music in media products that it delivers to clients. Those licenses are bundled with the delivered product. The licenses do not transfer to the client and do not extend beyond the client’s limited license.
AAS reserves the right to re-license images and video.
Licensed images and video may not be altered or used as a basis for, or included in, another work without the specific written permission of AAS.
Photographs and video of community amenities including, but not limited to, clubhouses, pools, tennis courts, golf courses, fitness centers, gates and guardhouses, and community signage are subject to the same licensing restrictions. AAS retains copyright to such images and video. Use of such images and video without specific written permission from AAS for any purpose other than marketing the specific property for which they were purchased is a copyright violation.
Licensing for media, including photos, video, and music, provided by the client to AAS for use in the final product is the sole responsibility of the client. The client agrees to indemnify AAS from any claim that results from such use.
Property Preparation: The client is expected to have the property cleaned and staged prior to the photo shoot. If the property is not ready to be photographed you should make every effort to reschedule not less than 24 hours prior to the scheduled shoot. AAS is not responsible for staging, cleaning, decluttering, landscaping, or otherwise preparing the property for photos. A preparation fee may be added if any of these services are requested at the time of the shoot. It is at the sole discretion of the photographer whether to provide such services. Access: The client is solely responsible for ensuring that the photographer has all necessary access to complete the shoot at the scheduled date and time.
Cancellation and rescheduling: By scheduling service you affirm that the property is ready for photos to be taken. If the photographer is unable to complete the shoot at the scheduled time due to nonperformance of the client, a $50 rescheduling fee will be applied, along with additional travel fees, if applicable. Nonperformance of the client includes, but is not limited to, the property not being prepared for photos or inability of the photographer to access the property because contact is not present or access arrangements (e.g., key in lockbox, security clearance) are not fulfilled. Rescheduling and travel fees will also apply to partially completed shoots that require an additional site visit to complete for the same reasons. We ask that if you must reschedule a shoot to do it at least 24 hours in advance.
Rescheduling due to weather: AAS reserves the right to reschedule due to weather. Rescheduling due to weather is at the sole discretion of AAS.
Aerial photography: Shoots that include aerial photography are subject to weather and FAA flight restrictions. AAS will advise the client if it is necessary to reschedule or reconfigure a shoot due to special considerations regarding aerial photography.
Quality guarantee: AAS and Ahead Photography make every effort to deliver high quality images and video to our clients. Our online portfolios are generally representative of the style and quality of our product. We ask that you review these portfolios and determine whether AAS style and quality will meet your needs before placing your order. If a client feels that a delivered product does not meet these standards, we will work with them to meet their expectation. AAS will perform a reasonable amount of post delivery editing on a limited number of images and/or limited video edits. Editing beyond these limits is billable at $75/hour, billed in half hour increments with a one hour minimum. If a client wants specific shots, we ask that you make a detailed request by email at least 24 hours prior to the scheduled shoot. This will enable the photographer to prepare the necessary equipment, charge batteries, etc, that may be required for the shots. If a client has special requirements, we ask that you discuss your requirements with AAS prior to scheduling service.
Delivery of photos and video: For most shoots, photos and video will be available online for download two business days after the shoot is complete. Photos and video will remain available for download for a minimum of 30 days. In the event a client needs a photo that is no longer available online, AAS can usually retrieve media from our archives on request. A $25 retrieval fee will apply.
Payment: Payment is due upon completion of the shoot. Full payment is required prior to delivery of the final images and video. AAS delivers invoices by email and offers secure online payment by credit card or check. Payments over 30 days past due are subject to finance charges. Other payment options may be available on request. We ask that you inform AAS in advance of the shoot if you need a purchase order.
By hiring Ahead Aerial Services, LLC (dba Ahead Photography) to provide photographic services, you are agreeing to be bound by these terms and conditions. You are also acknowledging that such agreement constitutes a binding contract between you and AAS.
Ahead Aerial Services, LLC reserves the right to change the above terms at any time without notice.
